The New Mexico Department of Workforce Solutions (NMDWS) will hold a public hearing to receive comments on proposed amendments to NMAC 11.1.2 – Public Works Minimum Wage Act Policy Manual.

What’s on the table

NMDWS is seeking input on:

  • Proposed prevailing wage and fringe benefit rates for 2026 for Public Works projects

  • Subsistence and zone pay updates

  • Minor revisions to job descriptions used on public works projects

Statutory authority

Under Section 9-26-4, NMSA 1978, NMDWS (Labor Relations Division) administers prevailing wage matters. Per Section 13-4-11, NMSA 1978, the Director determines prevailing wage and fringe benefit rates and may issue rules necessary to carry out the Public Works Minimum Wage Act.

How to comment

Interested individuals are encouraged to submit written comments by 5:00 PM on Wednesday, September 17, 2025 (earlier submissions are appreciated).

Questions / Copies of the proposed rule:

The proposed rule will be available at least 30 days prior to the hearing.
